This statement discloses the privacy practices for the Penn Lyon Homes, Inc. website - www.pennlyonhomes.com. The provision of this information and the corresponding assignment by Penn Lyon Homes of a personal password for each site registrant, will enable Penn Lyon to allow builders to take advantage of the online information and e-commerce features of the Penn Lyon Homes website. In addition, the information you supply will help Penn Lyon to offer you more personalized features, to tailor its websites to your interests and make them more useful to you.

The more you tell us about yourself, the more value we can offer you. Supplying such information is entirely voluntary. But it is necessary if you want to take advantage of some of the more advanced subscriber services offered by the Penn Lyon Homes website.

Upon request, Penn Lyon will remove any subscriber's information from it database, or allow any subscriber to opt out of further contact or to change/correct personal information that the subscriber states is erroneous.

With prior permission from customer at time of registration, using the e-mail addresses provided at registration, Penn Lyon may periodically send informational or special value notification e-mail to its subscribers about products and services offered by Penn Lyon (but not by third parties). Penn Lyon reserves the right to contact all subscribers about their account status or changes to the site's visitor agreement or privacy policy.

All information gathered on the Penn Lyon Homes website is encrypted for storage within a controlled database. However, as effective as encryption technology is, no security system is impenetrable. We cannot guarantee the security of our database, nor can we guarantee that information you supply won't be intercepted while being transmitted to us over the Internet.

Any information you include in a message you post to any chat room, forum or other public posting area is available to anyone with Internet access. If you don't want people to know your email address, for example, don't include it in any message you post publicly. In addition, Penn Lyon Homes is not responsible for the content or the privacy policies of Web sites to which it may link.

YOU, AND NOT PENN LYON HOMES, ASSUME THE ENTIRE COST OF ALL NECESSARY MAINTENANCE, REPAIR OR CORRECTION. UNDER NO CIRCUMSTANCES SHALL PENN LYON HOMES OR ITS AFFILIATES, AGENTS OR LICENSORS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES: THIS PROVISION INCLUDES, WITHOUT LIMITATION, ANY LIABILITY FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT, PUNITIVE OR SIMILAR DAMAGES, EVEN IF WE ARE ADVISED BEFOREHAND OF THE POSSIBLITY OF SUCH DAMAGES. YOU AGREE THAT THE LIABILITY OF PENN LYON HOMES AND ITS AFFILIATES, AGENTS, AND LICENSORS. IF ANY, ARISING OUT OF ANY KIND OF LEGAL CLAIM IN ANY WAY CONNECTED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO THE SERVICE OR THE USE OF THE SERVICE.

Termination
This agreement is effective until terminated by Penn Lyon Homes, at any time without notice. In the event of termination, you are no longer authorized to access the chat rooms, bulletin boards, or other public areas of the site, and the restrictions imposed on you wiht respect to material downloaded from the site, the disclaimers and limitations of liability set forth in this Agreement shall survive.

Other
This agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania without giving effect to any principles of conflicts of law. If any provision of this agreement is deemed unlawful, void for any reason unforceable, then that provision shall be deemed to be severed from this agreement and shall not affect the validity and enforceability of any remaining provisions.
